Sponsor: The contest is sponsored by Oliva Cigar Company, a Florida corporation, 6051 N.W. 153rd Street, Miami Lakes, Florida 33014.
1. Description of Contest/Participation.
A. Dates of Contest: The Contest will begin on or about April 1, 2008 and end on October 3, 2008.
B. How to Enter: NO PURCHASE NECESSARY. Pick up an official entry form on special displays at participating retail tobacco establishments during Nub Cigars promotional events specified herein. Sponsor reserves the right to add additional promotional events or cancel any promotional event at its sole discretion:

All entries must be received by Sponsor or the participating retail tobacco establishments during the promotional events.
C. Winner Selection: At the conclusion of each promotional event at participating retail tobacco establishments, a finalist will be selected in a random drawing from all entries received at each specific promotional event. The finalist must be present at the promotional event to participate in the Grand Prize event. The finalist selected at the promotional event will qualify for the final Grand Prize drawing, which will take place on October 3, 2008. The Grand Prize drawing will be webcast live, which is broadcasted on the internet, at all participating retail establishments that hosted promotional events on October 3, 2008. The Grand Prize winner must be present at the retail tobacco establishment on the day of the webcast in order to win the Grand Prize. At the Grand Prize drawing a winner will be selected from all finalists and the winner will receive the Grand Prize Mini Cooper, subject to the eligibility requirements set forth herein.
D. Grand Prize Event: The Grand Prize Event will take place on October 3, 2008, at which time the Sponsor will draw a randomly selected entry from all finalists. The winner will receive the Grand Prize Mini Cooper S Convertible. The winner must be present to win. Odds of winning depend on the number of eligible entries received.
2. Grand Prize. The prize that may be awarded to the eligible winner is:
One (1) Grand Prize will be awarded at the conclusion of the Contest. A 2008 Mini Cooper S Convertible will be the Grand Prize.
Approximate retail value: $28,000.
3. Eligibility and Limitations. Participants, finalists and the Grand Prize winner must be U.S. residents at least 21 years old and possess a valid drivers license. The winner of the Grand Prize must possess a valid driver’s license and show proof of automobile liability insurance or any other state automobile insurance requirements prior to taking possession of the Grand Prize. The Grand Prize cannot be transferred, redeemed for cash or substituted, except by Sponsor due to prize unavailability. In which event a prize of equal or greater value may be used. Except where prohibited by law, selection as a finalist as well as winner’s acceptance of the Grand Prize constitutes agreement for Sponsor to use finalist’s and winner’s name, photograph, likeness, statements, biographical information, voice and city and state of residence for promotional purposes on a worldwide basis in all forms of media and on the internet, without compensation. By participating in the Contest, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
Employees of Oliva Cigar Company, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
4. Delivery Disclaimer. All entries must be handwritten and delivered to Sponsor or representatives of the retail tobacco establishments at one of the promotional events set forth above. No photocopies or mechanical reproductions of entry forms is permitted. The Sponsor is not responsible for entry forms that are unintelligible or damaged or incomplete. The Sponsor is not responsible for any condition caused by events beyond the control of Sponsor that may cause the contest to be disrupted or corrupted or mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online information regarding the Official Sweepstakes Rules, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may
limit an online party’s ability to obtain contest information in order to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.
5. Release. By participating in the Contest, each participant, finalist and the Grand Prize winner waives any and all claims of liability against the Sponsor, its employees and agents, and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of the Grand Prize. In order to receive the Grand Prize, the winner must sign an official waiver form provided by the Sponsor. By accepting the Grand Prize, winner accepts the inherently dangerous nature and risk in driving an automobile, including personal injury and/or death, acknowledges that his/her participation in the Contest is voluntary, acknowledges that there are natural factors and occurrences which may impact on or affect the safety of the activities he/she is participating in and assumes the risk of such factors and occurrences and agrees that sweepstakes parties, including the Sponsor and the retail tobacco establishments shall not be in any way responsible for any resulting injury and/or death.
6. Indemnification. By participating in the Contest, you agree to release, indemnify, defend and hold harmless the Sponsor and the participating retail tobacco establishments from any and all losses, damages, injuries, rights, claims and actions, of any kind, in whole or in part, directly or indirectly, in connection with the Contest, or acceptance, possession, use or misuse of any prizes, including, without limitation, personal injury, death and property damage and claims based upon publicity rights, defamation or invasion of privacy. Entrant hereby waives all rights to bring a class action suit or to claim, punitive, incidental or consequential damages, or any other damages, including attorneys fees and entrant waives all rights to have damages multiplied or increased.
7. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Sponsor, and the value of any prize awarded to the Grand Prize winner may be reported for tax purposes as required by law. The Grand Prize winner is solely responsible for reporting and paying any and all applicable taxes related to the Grand Prize and paying any expenses associated with the Grand Prize which are not specifically provided for in the official rules. The Grand Prize winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before the Grand Prize will be awarded. The Grand Prize is not transferable, redeemable for cash or exchangeable for any other prize. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
8. Decisions. By participating in the Contest, participants, finalists and the Grand Prize agree to be bound by the decisions of Sponsor. The Sponsor reserves the right to disqualify any participant, finalist or the Grand Prize winner and may refuse to award the Grand Prize to a person who is ineligible or who the Sponsor believes has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Sponsor’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Sponsor deems appropriate. All decisions will be made by the Sponsor and are final. The Sponsor may waive any of these rules in its sole discretion.
8. Miscellaneous. The Grand Prize winner must submit proof of eligibility and sign the Sponsor’s release form to claim the prize. No purchase necessary to participate or win. Void where prohibited. Odds of winning depend upon the number of participants and entries received. The Sponsor disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Written copies of these rules are available during normal business hours at the business offices of Oliva Cigar Company, and by mail upon written request with a stamped, self-addressed return envelope. The rules are also available at www.nubcigar.com. All entries become the property of the Sponsor and will not be returned.
9. Compliance with Law. The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Sponsor shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific- on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law. This contest is offered only in the United States and is governed by the laws of the State of Florida, with venue in Miami-Dade County, Florida and all claims must be resolved in the federal or state courts of Miami-Dade County, Florida.
10, Winner Selection. Finalists for the Grand Prize drawing will be selected at the conclusion of each promotional event in a random drawing to take place at that event. Finalists must be present. The winner of the Grand Prize will be selected in a random drawing to be webcast live at each participating retail tobacco establishment on October 3, 2008 by Sponsor, whose decision will be final and binding of all matters related to the contest. Winner will be notified by certified mail. If winner cannot be located, the Grand Prize can be forfeited and an alternate winner may be selected. Winner will be required to complete and, sign and return an Affidavit of Eligibility/Liability Release.
11. Winner List. For the name of the Grand Prize winner send a self-addressed stamped envelope to Sponsor to : Oliva Cigar Company, Mini Cooper Sweepstakes, 6051 N.W. 153rd Street, Miami Lakes, Florida 33014.
